Former Subway spokesman and convicted porn peddler Jared Fogle is reportedly working to get out of prison, arguing that the judge who accepted his guilty plea didn’t have the jurisdiction to hear the case in the first place.
Per TMZ, Fogle, 40, is said to have drafted legal documents where he makes two arguments for his release: The first being that he was unjustly charged with conspiracy because it doesn’t apply to the charge of distributing sexually-explicit pictures of minors; despite pleading guilty to the charge, he also claims that he never travelled out of state to have illegal contact with children and that he had no hand in producing illicit images of children.

In 2016, Fogle was sentenced to more than 15 years in federal prison after pleading guilty to distributing and receiving child pornography, and traveling and attempting to travel to engage in illicit sexual conduct with a minor.
The latest move is yet another in a series of bizarre legal stunts Fogle has pulled in recent months. In November, Fogle unsuccessfully argued that he was a “sovereign citizen,” thus being immune to federal laws. The argument was swiftly thrown out, according to The Washington Post.

“If Fogle is now claiming to be ‘sovereign’, the Seventh Circuit has rejected theories of individual sovereignty, immunity from prosecution, and their ilk,” U.S. District Judge Tanya Walton Pratt.
“Regardless of his theory, Fogle’s challenge of this Court’s jurisdiction is rejected.”
