A former deputy in Colorado who admitted to creating a pornographic image involving a young boy learned he will not spend a day behind bars for the act.
Donald Fair, 45, agreed to plead guilty in late April to sex assault on a child by a person in a position of trust. It was on July 24 when he was sentenced to 10 years to life of sex offender intensive supervised probation and was ordered to register as a sex offender, according to KUSA.
Prosecutors said the former El Paso County Sheriff’s deputy listed the photo on a forum located on the Dark Web.
“If this interests you, email me back …. and we can talk,” Fair posted alongside an image showing a young boy, according to KCNC.
The Colorado Springs Police Department Internet Crimes Against Children unit got involved in August 2017, after the Department of Homeland Security asked them to investigate a possible child exploitation case referred to them by Interpol. It was during their investigation that they traced the IP address of the user offering the child pornography to Fair.
KOAA reported that Fair was arrested the same day the post was made and was terminated from his investigator role with the 4th Judicial District. Fair worked for the El Paso County Sheriff’s Office from 2005 to 2010 and from 2013 to July 2017.
“This outcome is the best we could hope for in this case under current Colorado law,” District Attorney George Brauchler said after last month’s sentencing, according to the news station.
“A young innocent child is not further traumatized by testifying and being cross-examined during a trial, and the perpetrator is monitored and given therapy to keep the community safe.”
