A Florida woman is facing additional charges based on her alleged actions following an arrest on suspicion of shoplifting at a Target.
According to the Palm Beach Post, 23-year-old Marley Barberian accused a veteran Palm Beach County sheriff’s deputy of sexual battery after she was arrested at the retailer in Greenacres.
The most recent charges come after the law enforcement agency conducted an internal investigation into the accused 55-year-old officer and found that “a preponderance of evidence does not exist to support the allegation.”
Among the evidence uncovered during the probe was video evidence showing a female deputy was transporting Barberian to jail at the time she claimed she was being sexually assaulted, according to authorities.
Police reports indicate she was booked into jail last week and is expected to face a criminal charge of accusing a law enforcement officer of sexual battery. She has since been released after posting $3,000 bail.
The felony count could land her in jail for five years with a $5,000 fine attached if she is convicted.
Initial charges stemmed from a January incident at the Target location on Lake Worth Road during which she was accused of stealing a total of $68.75 in merchandise.
One of the two deputies seen escorting her out of the store at that time was the individual she alleged took her to a wooded area and engaged in a sexual attack that included forcing his firearm inside her mouth.
Both officers initially involved did bring Barberian to the floor in a maneuver to restrain her after she slapped one deputy in the mouth, according to police reports. An investigation found the use of force was justified given the circumstances.
