A North Carolina mother and her boyfriend are expected in court Monday after her 1-year-old child was found unresponsive in a bathtub Sunday morning.

Sierra Eley, 27, has been charged with child abuse, and Marcus Richardson, 30, has been charged with first degree murder and child abuse, according to WTVD.

Rocky Mount police responded to calls about the unresponsive boy, identified as Romie Tyler III, at about 9 a.m. on Sunday.

The toddler was taken to UNC Nash Healthcare, where “exhaustive life-saving efforts” were unsuccessful, The Raleigh News & Observer reported.

Officials said the boy “had substantial bodily injuries,” although they didn’t say how those injuries occurred. An autopsy will determine cause of death.

Eley is being held on a $250,000 bond; Richardson is being held without bond, WITN said.
