Gabby Petito’s parents were scheduled to be questioned this week as part of a lawsuit against the parents of Brian Laundrie and their attorney, WFLA-TV reports.
The depositions – in which individuals are questioned under oath – were set for Tuesday and Wednesday for Petito’s parents, Joe Petito and Nichole Schmidt.
Laundrie’s parents, Chris and Roberta Laundrie, are scheduled to face questions in depositions scheduled for October 10 and 11. Brian Laundrie’s sister Cassie is expected to be questioned November 6, according to WWSB-TV.
Two social workers are also slated to be questioned in depositions, but their relation to the case is not clear.
Petito’s parents filed the lawsuit seeking damages for intentional infliction of emotional distress. The suit alleges that Laundrie’s parents knew that their son had murdered Petito in August 2021 but did virtually nothing in response except issue a statement that they hoped she would be located.
In a statement to WFLA-TV, the Petito family attorney, Pat Reilly, said he will be “Looking for whatever knowledge she has about Gabby’s death.”
A trial is scheduled for May 2024 in Sarasota County.
Petito’s parents in November were awarded $3 million in a separate wrongful death suit against Laundrie’s parents, NBC News reports. The awarded money will be used to fund the Gabby Petito Foundation, which was established after her death to “support locating missing persons and to provide aid to organizations that assist victims of domestic violence situations, through education, awareness, and prevention strategies,” according to the group’s website.
Petito, 22, went missing in August 2021 while on a cross-country road trip with 23-year-old Laundrie, then her fiancé. Her remains were found at a campsite in the Bridger-Teton National Forest in Wyoming on September 19, 2021. Authorities concluded that she died by manual strangulation.
After murdering Petito, Laundrie is believed to have driven the van the couple was traveling in back to his parents’ home in North Port, Florida, where he arrived on September 1 alone. He refused to discuss what happened with Petito’s parents, who reported her missing to police.
Laundrie would later drive to a nearby nature reserve in Florida about 10 minutes from his parents’ home, where he committed suicide. Investigators recovered what appeared to be a written confession by Laundrie that he murdered Petito.
