An attorney for a New Hampshire father charged with killing his 5-year-old daughter in 2019 has asked for a delay in the trial, currently scheduled to begin on November 20.
Adam Montgomery, 33, is charged with beating to death Harmony Montgomery, who was reported missing in December 2021, as CrimeOnline reported. The little girl hadn’t been seen in several years and remains missing. Police have said, however, that she is likely dead.

In a motion filed Wednesday, public defender Caroline Smith said that her co-counsel on the case had taken “a non-lawyer job with the Public Defender” and could not continue with the case. Additionally, Smith said, she was handling another homicide for most of October and would need extra time to bring on a new co-counsel and get them up to speed on the case.
Montgomery is willing to waive his right to a speedy trial on the matter, the motion said. Prosecutors have requested an immediate hearing.
Montgomery was sentenced last month to 30 to 60 years in prison on gun charges and an additional 7 1/2 to 15 years for theft and receiving stolen property. At his sentencing hearing, he denied any part in his daughter’s death.
“I did not kill my daughter Harmony, and I look forward to my upcoming trial to refute those offensive claims,” he said. “I could have had a meaningful life, but I blew that opportunity through drugs. I loved my daughter unconditionally and I did not kill her.”
