Two children drowned after falling into a pool at a home-based California daycare on Monday, and third was hospitalized.
San Jose Police said that several children fell into the pool but did not specify how many or their ages, KGO reported.
The Department of Social Services said that the daycare was licensed in January 2021 and has visited the site eight times, including one to discuss the pool. The licensees had to adjust the pool fence as a result of that visit.
The daycare was cited for three violations in January 2023, but inspectors found no violations in June. The last visit was a surprise inspection earlier this month in which the inspector cited the owners for not documenting safe sleep checks every 15 minutes.
The incident happened just after 9 a.m. at Happy Happy Daycare, according to KNTV. All three children were initially taken to the hospital in critical condition.
The Santa Clara County District Attorney’s Office is working with San Jose Police determine if any charges will be filed.
