13-Year-Old to Remain in Adult Jail After Killing Mom as She Slept Near Newborn

A Florida judge ruled on Thursday that a 13-year-old boy charged with killing his mother will remain in an adult detention center as he decides if he will be transferred.

Derek Rosa reportedly stabbed Irina Garcia, 39, on October 12 at their Hialeah as Garcia slept not far from her 14-day-old daughter. Rosa was moved from the Juvenile Detention Center to the Metro West Detention Center after he was indicted on first-degree murder charges, according to WTVJ.

However, Rosa’s attorneys have expressed concerns regarding the 13-year-old’s safety. While he considers the matter, the judge ruled that Rosa will remain at Metro West Detention Center and scheduled a hearing in a few weeks.

WTVJ reported that Rosa is housed with a small group of minors at the adult jail. However, Rosa’s attorney, TK, told the news outlet that most of the other jailed minors are 17.

Rosa allegedly called 911 after stabbing Garcia multiple times in the neck. Rosa allegedly told a 911 dispatcher that he sent pictures of his dead mother to someone he met online. He went on to tell the dispatcher that there was blood all over the floor.

“I took pictures and I told my friend about it,” he allegedly said in the 911 call. “Was that bad?”

Garcia’s husband, who is Rosa’s stepfather, was out of state when the slaying occurred. WPLG reported that the judge will decide whether Rosa will remain in an adult jail on November 17.
