A Florida state’s attorney released photos on Monday showing the scene where a 13-year-old 8th grade honor student is accused of stabbing his mother to death in October.
One photo shows Derek Rosa standing over 39-year-old Irina Garcia, sleeping in her bed the night of the killing. Another, taken from the same baby monitor in the room, shows Garcia cudding with her 14-day old baby, who was sleeping in her crib when the teen killing their mother.
Rosa called 911 to report that he’d just killed his mother on October 12, as CrimeOnline reported. He reportedly told the dispatcher he sent pictures to a friend online and asked, “Is that bad?”
Miami-Dade Judge Richard Hersch is expected to decide this week on a requested by Rosa’s attorneys to house him in the juvenile detention center instead of the adult jail where he is now awaiting trial, WTVJ reported. He gave the attorneys until Tuesday to present their arguments but said that if they need more time, he’d hold a hearing on Thursday.
Jail officials told the station that Rosa is kept in isolation in the juvenile section at the Metro West jail in Doral along with other juveniles, all of whom are 16- and 17-year-old. He has no contact with them, however, and only interacts with jail staff.
Prosecutors oppose the move to a juvenile detention center.
Last week, defense attorneys spent about three hours examining the crime scene.
The photos released on Monday also include pictures of the bloody knife used in the stabbing and a selfie showing Rosa with a bloody hand. Prosecutors say that is among the photos the teen sent to his online friend.
Rosa pleaded not guilty after a grand jury indicted him on a first degree murder charge.
