An Indiana woman accused of killing her husband laughed and joked with emergency personnel as he lay dying on the floor of their New Haven home last summer.
Alison K. Davis, 33, was charged with felony murder on Thursday and booked into the Allen County Jail, WANE reported. She is accused of causing the injuries suffered by Kevin Ray Davis, 40, on August 12.
Alison Davis called 911 just after 4:30 a.m., saying she had found her husband at the bottom of the stairs in a pool of blood, court documents say. When medics arrived, he was barely breathing, and he died that afternoon at a hospital.
The doctor who treated him at the hospital told investigators that Davis had possibly been brain dead for several hours.
“(The doctor) stated that she has had drowning victims with more oxygen in their brain,” an investigator wrote in can affidavit.
Davis’s story revolved around the idea that her husband fell down the stairs, but the doctor said his injuries were not consistent with a fall. His injuries, the doctor said, were “isolated to the head” with “multiple skull fractures and orbital fractures.” And, the doctor said, his core body temperature was so cold that was hyperthermic when he arrived at the hospital.
An autopsy determined that the right side of his skull had been crushed by a blunt object. He was brain dead on impact, according to the forensic pathologist who conducted the autopsy.
Court documents say that Alison Davis’s behavior was “odd” and “inappropriate.”
“At one point the Defendant was laughing with Medics and did not seem concerned about her husband’s injuries,” an affidavit says.
After telling multiple versions of what happened that night, she finally settled on telling investigators that she and her husband had been out drinking and came home at around 1 a.m. They fought, she said, and she decided to sleep downstairs while he went upstairs to bed. some time later, she reported hearing a “thud” and found her husband at the bottom of the stairs.
But she told other people different versions, telling medics on the scene that she “never heard anything and that it had been a while since she had seen her husband.” She reportedly told her brother-in-law that she was in bed with the couple’s dog while her husband was up walking around. She told him she heard a “thud” but had no idea what it could have been, so she checked and found Kevin Davis at the bottom of the stairs.
The affidavit also said that Kevin Davis’s mother told investigators that the couple had not been drinking hat night. She said that Alison Davis told her that she and her husband were upstairs sleeping when the husband got up to get water. Alison Davis told her mother-in-law that she heard a loud “bang” and went to investigate.
Investigators did not locate a weapon at the home at the time. Doctors who examined Davis, however, said that it appeared his injuries were caused some time before his wife called 911, meaning there was plenty of time to dispose of a possible weapon.
“Due to the nature of the injury and Defendant’s inconsistent statements your affiant believes and has evidence to support that the Defendant knowingly and intentionally caused the death of Kevin Davis,” the affidavit says..
Alison Davis faces 45 to 65 years in prison if convicted.
