Landlord’s Boyfriend Shoots and Kills Tenant Who Won ‘Illegal Eviction’ Case: Police

A Texas man is dead after police say a landlord’s boyfriend shot him after the victim was successful in overturning an eviction.

According to SAPD spokesman Sgt. Washington Moscoso, Shawn Pivonka, 37, has been arrested and charged in the death of David Beck, 41. Pivonka has been charged with murder and remains jailed at the Bexar County jail.

Investigators said the incident happened on December 14, in the 1000 block of West Huisache Avenue in San Antonio. Pivonka is accused of shooting Beck after both men began arguing with each other and pulling out guns.

Beck, who had a successful “overturning of the illegal eviction,” intended to present the documentation to the landlord that morning, Moscoso said. The landlord, identified as Pivonka’s girlfriend, had previously attempted to evict Beck and became upset with the eviction was tossed.

Court records from Bexar County verify that Beck was involved in two ongoing legal disputes related to eviction, KSAT reports.

“The landlord obviously was upset about it,” Moscoso said. “The landlord’s boyfriend got into the mix. Things escalated from that point.”

“He stepped back and said, ‘Hey, take it easy. Don’t hit me.’ The victim was carrying a weapon. He brought out his weapon in a defensive manner. The suspect was also carrying a firearm. He pulled out his weapon in an offensive manner and shot the victim, killing the victim on the scene.”

After reviewing video evidence, police arrested Pivonka on December 20.

“There was enough evidence to merit the charge of murder,” Mocoso said, adding that Pivonka does not have a criminal history.
