UPDATE: 1-Pound Baby Found Dead in Restaurant Toilet After Mom Possibly Miscarried

A baby discovered in a restaurant bathroom late last month may have been the result of a miscarriage, New York officials said on Tuesday.

The fetus — who the New York City medical examiner’s office determined was a boy at 22 to 23 weeks gestation — was discovered by staff at Sophie’s Cuban Cuisine 30 minutes before opening.  NYPD Chief of Detectives Joseph Kenny said a 20-year-old customer who used the bathroom there the day prior might have suffered a miscarriage, according to the New York Daily News.

The fetus, which weighed a little more than a pound, was reportedly discovered in a clogged toilet at the restaurant on September 30.

“She leaves the bathroom and employees are alerted that the bathroom is dirty. The next day, they come in and find that it’s clogged,” Kenny explained, according to WPIX.

Kenny said authorities have identified the woman, who has not been publicly named. The medical examiner believed the baby might have taken one or two breaths but was unable to survive.

Kenny also revealed on Tuesday that the Manhattan District Attorney’s Office is determining whether criminal charges will be filed in this case.

“Most likely it would lead to the arrest of concealment of a human corpse, which is a (class) E felony,” he said, according to WPIX.
