Middle School Teacher on Trial for Crashing Into, Killing 10-Year-Old Riding Bike

A Colorado middle school teacher is on trial for killing a 10-year-old boy who was struck while riding his bicycle.

Prosecutors charged Amy Weiss, 54, with careless driving resulting in death and tampering with evidence after she allegedly hit Oliver Stratton in August 2023.

The incident happened in August 2023 as Oliver crossed Saddle Horn Drive and River Pass Road in Larimer County.

The Larimer County Sheriff’s Office said in a news release that “several environmental factors impacted visibility for both (Weiss) and (Stratton)” in the neighborhood just before 6 p.m. Investigators also found evidence of “distracted driving,” the release said, according to Court TV.

At the opening of her trial on December 16, Weiss admitted to tampering with physical evidence, with prosecutors alleging she deleted a text message shortly after the crash.

KDVR reports that defense attorneys argued that she had less than two seconds to see the victim before the crash, as another driver had obstructed her view.

Weiss’ trial is set to run through December 20, with a sentencing hearing on the evidence tampering charge, scheduled for March.

She could face up to a year in jail when she is sentenced on March 7.
